By visiting or using the Art Council Wines website (“Site”), placing an order, or enrolling in membership, you agree to these Terms of Service and our Privacy Policy. These terms govern your relationship with us, including purchases, membership, and use of the Site. They are written to be read, not buried. We ask that you take a moment with them.

 

 

1. Acceptance Of Terms

By accessing or using the Art Council Wines website located at artcouncilwines.com (the "Site"), placing an order, or creating an account, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.

These Terms apply to all visitors, users, customers, and others who access or use the Site. Art Council Wines reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Site constitutes acceptance of any revised Terms.

 

 

2. Content & Use

All content on this Site — including visuals, text, label designs, editorial copy, photography, and brand assets — is owned by or licensed to Art Council Wines. All content is provided for personal, non-commercial use only. Unauthorized reproduction, modification, or distribution is prohibited.

  • You may not copy, scrape, republish, or use Site content for commercial purposes without prior written consent from Art Council Wines.

  • Content on this Site may be updated, changed, or removed at any time without prior notice.

  • By accessing the Site, you agree not to use its content in any way that violates applicable laws, infringes on third-party rights, or misrepresents your affiliation with Art Council Wines.

 

 

3. Age Requirement & Verification

You must be 21 years of age or older to access or purchase from this Site. By placing an order, you confirm that you and the recipient of any shipment are of legal drinking age.

At delivery, carriers require an adult signature (21+). State and federal laws prohibit leaving alcohol at a doorstep without age verification. Art Council Wines complies with all federal, state, and local laws governing the sale and shipment of alcoholic beverages.

We reserve the right to cancel orders if age verification requirements are not met. We do not knowingly sell alcohol to minors. If we become aware that a purchase has been made by or for a minor, the order will be cancelled and a full refund issued.

 

 

4. Ordering, Payment & Fulfillment

When you place an order through the Site, you are making an offer to purchase the products in your cart. We reserve the right to accept or decline your order for any reason, including product unavailability, pricing errors, or suspected fraud.

  • Accepted Payments: Visa, MasterCard, American Express, ShopPay, PayPal, Apple Pay, and Discover. All payments are processed securely through Shopify's payment platform. Art Council Wines does not store your full credit card information.

  • Processing: Orders are processed within 2–4 business days. Weekends and holidays do not count as processing days.

  • Tracking: You will receive tracking details by email once your order ships.

  • Cancellations: All sales are final once placed. In some circumstances, we may attempt to recall an order before it ships, but applicable shipping fees will apply.

Prices are listed in US Dollars and are subject to change without notice. Applicable sales taxes will be calculated and displayed at checkout.

 

 

5. Shipping & Delivery

Art Council Wines ships to states where direct-to-consumer wine shipment is legally permitted. Please see our Shipping Policy for the current list of eligible states. It is your responsibility to verify that wine shipments are legal in your state of delivery.

  • Carrier: We ship via UPS Ground or equivalent. Expedited shipping is available at cost.

  • Signature Required: All wine deliveries require an adult signature (21+). Carriers will not leave packages without verification.

  • Membership Shipments: Art Council Insider members receive quarterly shipments unless otherwise noted.

  • Temperature Sensitivity: Wine is perishable. We recommend expedited shipping in extreme hot or cold climates. Art Council Wines is not liable for heat or cold damage once the package leaves our warehouse.

  • No P.O. Boxes: We are unable to ship to P.O. boxes.

Shipping times are estimates and not guaranteed. Art Council Wines is not responsible for delays caused by carriers, weather, or circumstances beyond our control. Risk of loss passes to you upon delivery to the carrier.

 

 

6. Membership Terms

The Art Council Insider is our membership program offering early access to limited releases, curated quarterly shipments, artist spotlights, and exclusive event invitations.

  • Quarterly Shipments: Members receive curated shipments of Art Council Wines 4 times per year.

  • Billing: Credit cards will be automatically billed prior to each shipment cycle. By enrolling, you authorize recurring charges to your payment method on file.

  • Changes to Membership: Members may update their shipping address, skip a shipment, or pause their account by contacting us at least 14 days before the next billing cycle.

  • Cancellation Policy: Membership cancellations require at least one full billing cycle's notice. Early cancellations may result in a fee equal to the cost of one standard shipment.

Art Council Wines reserves the right to modify membership benefits, pricing, and shipment contents with advance notice to members.

 

 

7. Returns, Refunds & Claims

All sales are final. Due to alcohol shipping laws, we cannot accept returns or exchanges for orders placed in error.

  • Damaged Goods: If your package arrives damaged, incorrect, or lost, please email us at info@artcouncilwines.com within 7 days of delivery with your order number and photographs. We will assist in filing a carrier claim or sending a replacement where appropriate.

  • Undeliverable Orders: Packages returned as "undeliverable" by the carrier cannot be reshipped due to product integrity concerns. Applicable shipping charges will still apply.

  • Merchandise: Non-alcoholic items (apparel, accessories, gift sets) may be returned within 14 days of delivery if unused and in original packaging. Opened or used items are not eligible for return.

 

 

8. Intellectual Property

All trademarks, logos, label designs, artwork, and content are the exclusive property of Art Council Wines and its licensed artist collaborators. Unauthorized use, reproduction, or distribution of these assets is strictly prohibited.

The artwork featured on our wine labels is the original work of our commissioned artists. Each artist retains creative credit and is compensated for their collaboration. Use or distribution of any label artwork without the explicit written consent of Art Council Wines and the relevant artist is a violation of intellectual property law.

The Art Council Wines name, logo, and all related product names, designs, and slogans are trademarks of Art Council Wines. You must not use such marks without our prior written permission.

 

 

9. Links to Third-Party Sites

This Site may contain links to third-party websites for your convenience. Art Council Wines does not control or endorse third-party sites and is not responsible for their content, privacy practices, or accuracy. Accessing third-party sites through links on our Site is entirely at your own risk.

The inclusion of any link does not imply endorsement by Art Council Wines. We encourage you to review the privacy policies and terms of any third-party sites you visit.

 

 

10. Communications

By subscribing to our mailing list or Art Council Insider membership, you agree to receive updates, shipment notifications, and promotional content from Art Council Wines. You can unsubscribe at any time by following the unsubscribe link in any email or by contacting us directly at info@artcouncilwines.com. Standard carrier and data rates may apply.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your personal information to third parties.

 

 

11. Disclaimer of Warranties to Terms

The Site and all content, products, and services included on or available through the Site are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.

Art Council Wines disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Alcohol consumption advisory: Art Council Wines encourages responsible consumption of alcohol. Excessive consumption of alcohol can be harmful to your health. Do not drink and drive. The Surgeon General warns that women should not drink alcoholic beverages during pregnancy because of the risk of birth defects.

 

 

12. Limitation of Liability

To the fullest extent permitted by applicable law, Art Council Wines and its officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, data, goodwill, or other intangible losses — resulting from your access to or use of (or inability to access or use) the Site or products.

In no event shall our total liability to you for all claims arising from or relating to these Terms or your use of the Site exceed the amount you paid to Art Council Wines in the twelve (12) months preceding the claim.

 

 

13. Disputes & Governing Law

These Terms are governed by the laws of the state where Art Council Wines is headquartered, without regard to conflict of law provisions. Disputes will be resolved under applicable state and federal alcohol and commerce regulations.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

 

 

14. Changes to These Terms

We may update these Terms of Service at any time. Updates will appear on this page with a new effective date. Your continued use of the Site following any update signifies your agreement to the revised Terms.
